Specialising in financial and corporate restructuring and insolvency matters, our team has worked on many of the major cross-border restructurings and insolvencies of the past decade.
We are experienced in all stages of the restructuring or insolvency process. Thanks to our vast sectoral expertise, we act for a wide range of clients, including domestic and international borrowers, lender groups, creditors, shareholders, directors, sponsors as well as bidders in distressed transactions. Teamwork with colleagues from our other practice groups enables us to deliver a comprehensive legal service for both in-court and out-of-court restructurings and settlements.
Services
Our team has broad experience in domestic and international restructuring mandates, using both foreign proceedings (e.g. the English restructuring plan proceedings) and national out-of-court restructuring proceedings (e.g. the Dutch scheme (WHOA)). Lawyers from our team are regularly appointed by the court to act as bankruptcy trustees, administrators in suspension of payments proceedings and restructuring experts in out-of-court restructurings.
Acting on debt and corporate restructurings, we handle issues regarding capital restructuring, including rescue rights issues, rescheduling of debts, moratoriums, standstills, debt to equity swaps, distressed M&A transactions, plans of composition, and restructuring by means of insolvency proceedings.
By drawing on our expertise in corporate finance, mergers and acquisitions, litigation and tax, employment, environment and planning, EU and competition law, we handle matters in the most integrated and coordinated way.
We have proven experience in combined formal insolvency procedures in various jurisdictions around the world. We assist clients who are confronted with complex restructuring and liquidation issues.
Alongside our advisory work and appointment as bankruptcy trustee and liquidator, we focus on litigation work. We have been involved in various high-profile matters that include restructuring issues or important insolvency litigation. We act for creditors and board members in proceedings in high-profile bankruptcies. Our team also has particular expertise in proceedings in respect of fraudulent conveyances and directors’ liability.
