Stibbe advises listed telecom player
Stibbe assisted a major listed telecom player in its bid for the public procurement contract to be awarded by the three regions in Belgium regarding the introduction of a road charging system.
This is the most complex PPP road project that is being put on the market for the coming years. The three Belgian regions are jointly calling a tender that is based on a user charge system, the collection of toll, and the enforcement of the system for the use of the Belgian motorways by trucks (with an extension to the entire Belgian road network). It also includes a “vignette” system for passenger cars.
Our work included the preparation of the telecom client's offer for the road charging project in the three Belgian regions (which consisted of administrative law (including public procurement aspects), IT, IP, and privacy issues).
EU rules on road charging are key to this project. The Belgian road charging project will have to comply with European rules concerning electronic road charging. These rules concern user charges and toll (Directive 1999/62/EC), interoperability of the electronic tolling systems (Directive 2004/52/EC) and the framework for the deployment of Intelligent Transport Systems in the field of road transport and for interfaces with other modes of transport (Directive 2010/40/EU).
