Stibbe wins procedure for municipality of The Hague

Following the introduction of a new national financial distribution model, the large municipalities of The Hague, 's-Hertogenbosch, Amersfoort and Utrecht have been allocated insufficient government funds to finance social security payments. On 1 July 2019, the Central Appeals Tribunal ruled that this was unlawful and instructed the Ministry of Social Affairs to find a new distribution method.

The municipalities welcome this decision; all the more so since they are increasingly being tasked with greater responsibilities from the government without adequate funding. The judgment is also important in a more general sense because it sets a new, higher, standard for the assessment of generally binding regulations. From now on, these assessments will be more critical and more intensive.
