Stibbe represents Mercedes-Benz in class action concerning NOx emissions from diesel vehicles

Stibbe is acting as defence counsel for Mercedes-Benz in mass litigation over allegations that the company installed prohibited defeat devices in its diesel-powered vehicles. 

This case marks one of the first proceedings brought under the new Dutch opt-out regime for collective actions, where multiple claim vehicles are competing to be appointed as lead plaintiff. The three plaintiffs are foundations supported by US or UK-based litigation funders and law firms. Each foundation is seeking damages for all customers who bought or leased Mercedes-Benz diesel-powered vehicles in the Netherlands between 2009 and 2019.
