We assisted KLM in a law suit filed by 150 air line pilots and former pilots of Martinair.
The pilots claimed that the TUPE regulations applied to the job that was offered to them after Martinair stopped its passenger business, including conservation of seniority rights. KLM was successful in the proceedings, both in the first instance and on appeal. On 1 May 2018, the court of appeal in Amsterdam ruled in favour of KLM/Martinair. This judgment was annulled by the Supreme Court in 2020 and referred to the court of appeal in The Hague.
